Content Policies:

All services may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material protected by trade secret and other similar statutes, as well as material we judge to be threatening or obscene.

Sites that promote any illegal activity or content that may be damaging to our servers or any other server on the Internet is likewise prohibited . Links to such materials are also prohibited. This would include pirated software, hackers programs or archives, Warez sites, IRC Bots, Mp3, bulk e-mail services and/or software. Pornography, nudity and sex-related merchandising are prohibited on all of our servers. This includes sites that may infer sexual content, or link to adult content elsewhere. The client is solely responsible for the content available through their web presence on Pomfret's servers.

To report any violations, please contact [email protected]. We have the right, but not the obligation, to remove or deny access to such content . We further reserve the right to disclose content and or records as required to satisfy any law, regulation, or government branch request.

Traffic Guidelines:

Due to the unique resource characteristics and traffic patterns associated with certain types of sites, we do not allow sites whose primary function is image galleries, file transfers, software distribution or dissemination of similar materials via our services.

Resource Utilization:

We do not penalize businesses for being successful. However, if your site consumes an unreasonable amount of system resources and degrades the performance of any Pomfret service, you will be contacted to discuss more appropriate arrangements.

Dynamic Scripts:

Each domain hosted account is provided with its own cgi-bin. Clients are free to use CGI/Perl scripts, however, we reserve the right to disable any dynamic script that effects normal server operations. We do not provide technical support with respect to the scripts the client may choose to utilize in this format.

Our servers also support PHP which is a third party scripting engine. Please note, we do not provide technical support with respect to the PHP scripts clients may choose to utilize. There are many on-line resources and references available for PHP.  It is up to the client to ensure their PHP applications are updated and compatible with the latest version(s) of PHP.  Once a specific version of PHP reaches end of life status, it it removed from shared hosting environments.

We do not allow running chat rooms, streaming services, or other bandwidth/resource intensive applications on shared hosting environments. These can be substantial users of system resources and therefore we cannot allow them without our prior review and consent. Certain restrictions and limitations may apply.

Unsecure Scripts / Applications:

Clients are responsible for maintaining the security and updates of self-installed scripts/applications.  Should a client-installed application be compromised, it will be disabled immediately.  Depending on the severity of the compromise, the entire website may be suspended, at our discretion.

Background Running Processes:

We may allow programs to run continually in the background. These are considered on a one-by-one basis. An extra charge will be incurred based on resource requirements and operational maintenance.

IRC:

We do not allow IRC or IRC bots to be operated on our servers.

Unsolicited Commercial Advertising / SPAM - E-mail:

Our servers may not be the source, intermediary, or destination address involved in a transmission of spam, flames, viruses, or mail bombs. A client's account on our servers may not be referenced as originator, intermediary, or reply-to address in any of the above. We consider spam to be any unsolicited commercial e-mail or unsolicited bulk e-mail in the mediums of Newsgroups, E-mail, or Fax. If a client is found to have intentionally spammed, then we have the right, though not the responsibility, to immediately, without warning, disable the account.

Server Abuse:

Any attempts to undermine or cause harm to a server is strictly prohibited. Any violation will result in immediate deactivation of services without refund. Criminal and/or civil actions may be sought against the client by Pomfret Computer Technologies, LLC as result of such abuse.

Refusal of Service:

We reserve the right to refuse or cancel service at our sole discretion. Failure to comply with any terms or conditions will result in immediate account deactivation without refund.

Indemnification:

Client agrees that it will protect, indemnify, save and hold Pomfret Computer Technologies, LLC harmless from any and all claims, liabilities, losses, and expenses as well as attorney's fees assessed against Pomfret Computer Technologies, LLC, its officers and its clients . If Pomfret Computer Technologies, LLC is sued because of activities of the client, the client will pay any damages awarded against Pomfret Computer Technologies, LLC, plus costs and reasonable attorneys' fees.

Pomfret Computer Technologies, LLC will not be responsible for any damages a client or a client's business may suffer. Pomfret Computer Technologies, LLC makes no warranties of any kind, expressed or implied for the services it provides, unless otherwise specifically stated.
